§ 2622. Actions. 1. In any case founded upon tort a notice of claim\nshall be required as a condition precedent to the commencement of an\naction or special proceeding against the authority or any officer,\nappointee or employee thereof, and the provisions of section fifty-e of\nthe general municipal law shall govern the giving of such notice.\n  2. Except in an action for wrongful death, no action shall be\ncommenced (a) prior to the expiration of thirty days from the date on\nwhich the demand claim or claims upon which the action is founded were\npresented to a member of the authority or other officer thereof\ndesignated for such purpose; nor (b) more than one year and ninety days\nafter the cause of action therefor shall have accrued. An action against\nthe authority for wrongful death shall be commenced in accordance with\nthe notice of claim and time limitation provisions of title eleven of\narticle nine of this chapter.\n  3. The venue of any action or proceeding against the authority or its\nmembers, officers, employees or agents, or in which any question arises\nas to the validity of any section of this act, shall be laid in the\ncounty in which the principal office of the authority is located.\n  4. Notwithstanding subdivision three of this section, exclusive\njurisdiction is hereby conferred upon the court of claims to hear and\ndetermine any claim of any person brought hereafter against the\nauthority to recover damages for injuries to property or for personal\ninjury arising out of the operation by the authority of any\nparticipating olympic facility owned by the state or of the Belleayre\nMountain ski center or of the Gore mountain ski center, in the same\nmanner and to the extent provided and subject to the provisions of the\ncourt of claims act with respect to claims against the state, and to\nmake awards and render judgments therefor. The payment of awards and\njudgments for any such claims brought in the supreme court pursuant to\nthis title or in the court of claims shall be made from appropriations\nfor judgments against the state pursuant to section twenty of the court\nof claims act.\n
