Temporary restraining order or preliminary injunction pending disciplinary proceedings

Notwithstanding
the provisions of chapter 622A of NRS:
1. Pending disciplinary proceedings before
the Board, a panel of its members or a hearing officer, the court may, upon
application by the Board or the Attorney General, issue a temporary restraining
order or a preliminary injunction to enjoin any unprofessional conduct of a psychologist,
behavioral health and wellness practitioner, psychological assistant,
psychological intern or psychological trainee which is harmful to the public,
to limit the psychologists, behavioral health and wellness practitioners,
psychological assistants, psychological interns or psychological trainees
practice or to suspend the license to practice psychology or behavioral health
promotion and prevention, the registration to practice as a psychological
trainee or the provisional license to practice as a psychological assistant or
psychological intern, without proof of actual damage sustained by any person,
this provision being a preventive as well as a punitive measure.
2. The disciplinary proceedings before the
Board, a panel of its members or a hearing officer must be instituted and
determined as promptly as the requirements for investigation of the case
reasonably allow.
