1. Except as otherwise provided in subsection 2: (a) It is unlawful for a person to manufacture, distribute or act as a guarantor of commercial feed in this State unless the person has been issued by the Department a license pursuant to NRS 587.869 ; and (b) A person who manufactures, distributes or acts as a guarantor of commercial feed must obtain a license from the Department for each facility in this State: (1) Where he or she intends to manufacture or distribute commercial feed. (2) For which he or she is a guarantor of any or all of the commercial feed that is manufactured at or distributed from the facility. 2. A person is not required to obtain a license pursuant to subsection 1 if he or she conducts only retail sales of commercial feed and the packaging of the commercial feed includes a label indicating that the commercial feed is from a manufacturer or distributor who is licensed pursuant to subsection 1.
