Liability for unlawful payment: Action for recovery; disposition of proceeds of action

1. Every officer who willfully makes a
payment of salary or compensation contrary to the provisions of this chapter
and any officer who signs, countersigns, or authorizes the signing or
countersigning of any warrant for such a payment, and the sureties on the
officers official bond, are liable to the State of Nevada therefor.
2. An action to recover such a payment may
be maintained in the district court of any county by the Administrator or a
member of the Commission.
3. All money recovered in such an action,
when collected, must be paid into the appropriate fund in the State Treasury.
