Event held by qualified organization that is permittee; restrictions

Sec. 5. Unless approved by the commission under subdivision (7), the following restrictions apply to an event held by a qualified organization if the qualified organization is a permittee: (1) The qualified organization may not accept a cash donation from another permittee. (2) The qualified organization may not accept a donation from a permittee in exchange for agreeing to accept: (A) alcoholic beverages; or (B) certain types or brands of alcoholic beverages; to the exclusion, in whole or in part, of alcoholic beverages or types or brands of alcoholic beverages from another permittee. (3) A permittee must provide the qualified organization, at the time of delivery, a written record of the amount of alcoholic beverages donated by the permittee. (4) The qualified organization must maintain a record of every alcoholic beverage: (A) donated by a permittee; and (B) consumed during the event. (5) A permittee may not offer anything of value to another permittee in exchange for the other permittee making a donation to the qualified organization. (6) The qualified organization may not sell donated alcoholic beverages as part of the qualified organization's normal inventory. (7) A qualified organization that is a permittee may apply to the commission for permission to accept a cash donation from another permittee. The commission shall designate the form and manner for an application under this subdivision. The commission's determination regarding an application under this subdivision is final and not subject to administrative or judicial review.
