West Virginia Code § 46B-8-1

For a violation of or a failure to comply with the provisions of this article by a dealer, a
consumer is entitled to recover from the dealer the consumer's actual damages, reasonable
attorney's fees and court costs and a civil penalty in an amount not less than $100 nor more
than $1,000 for each violation.
