West Virginia Code § 38-2-38

Enforcement of lien by executor, administrator or assignee

The executor or administrator of any person entitled to a lien under this article, or any
assignee of the claim upon which such lien is based, shall be entitled to such lien, and to the
right to perfect and enforce such lien, in the same manner and to the same extent as the
testator, intestate, or assignor could have done, had he remained the owner of such claim.
