West Virginia Code § 33-46A-10

Rule-making authority; fees

(a) In addition to the authority to propose rules as provided in section seven of this article,
the commissioner may propose rules for legislative approval in accordance with the
provisions of article three, chapter twenty-nine-a of this code, to implement the provisions of
this article, including but not limited to:
(1) Requirements for the issuance and renewal of licenses;
(2) Requirements for denying, suspending, revoking, reinstating or limiting the practice of a
licensee; u
(3) Requirements for activating inactive or revoked licenses;
(4) Special financial and other licensing requirements afor small, start-up PEOs; and
(5) A schedule of fees.
(b) The commissioner may promulgate emergency rules pursuant to the provisions of section
fifteen, article three, chapter twenty-nine-a of this code, for any purposes set forth for
legislative rules in subsection (a) of this section.
