Enforcement of provisions by commissioner; rules

It is the function and duty of the Commissioner of Highways to administer and enforce the
provisions of this article, and in the performance of duties hereunder, the commissioner may
assign to other employees in the department, such duties as he or she may deem proper. The
commissioner may propose rules for legislative approval in accordance with the provisions of
article three, chapter twenty-nine-a of this code relating to the implementateion and exercise
of the authority granted by this article, including rules permitting the State of West Virginia
to comply with the provisions of Title 23, Chapter 6 of the United Staters Code relating to the
federal State infrastructure bank program; and for receiving, reviewing, evaluating and
selecting projects for which financial assistance will be approved.
