Outdoor Recreation Mitigation Grant Fund created

(1) There is created an expendable special revenue fund known as the "Outdoor Recreation
Mitigation Grant Fund," which the division may use to make competitive outdoor recreation
mitigation grants to one or more eligible counties as described in Section 79-9-201.
(2) The fund consists of:
(a) deposits into the fund under Subsection 59-28-103(4)(a);
(b) appropriations made by the Legislature;
(c) private donations, grants, gifts, bequests, or money made available from any other source to
implement this chapter;
(d) any grant funding that is returned to the division from an eligible county, as described in
Section 79-9-203; and
(e) interest earned on the fund.
(3) The division shall, with the advice of the board, administer the fund.
(4) The cost of administering the fund:
(a) shall be paid from money in the fund; and
(b) may not exceed 2% of the revenue deposited annually into the fund under Subsection
59-28-103(4)(a).
(5) Interest accrued from investment of money in the fund shall remain in the fund.
