(1) There is created the Cosmetology and Associated Professions Licensing Board consisting of
the following members:
(a)
(i) one cosmetologist; or
(ii) one cosmetologist instructor;
(b)
(i) one master esthetician; or
(ii) one master esthetician instructor;
(c)
(i) one nail technician; or
(ii) one nail technician instructor;
(d)
(i) one electrologist; or
(ii) one electrologist instructor;
(e) one representative of a licensed school that is publicly funded;

(f) one representative of a licensed school that is privately funded;
(g) one supervisor as defined in Section 58-1-505; and
(h) two members from the general public.
(2)
(a) The board shall be appointed and serve in accordance with Section 58-1-201.
(b) Except for the members specified in Subsections (1)(e) and (1)(f), a member may not
participate as a representative of a licensed school.
(3)
(a) The board shall perform the duties and responsibilities described in Sections 58-1-202 and
58-1-203.
(b) The board shall designate one of the board members on a permanent or rotating basis to:
(i) assist the division in reviewing complaints concerning the unlawful or unprofessional conduct
of a licensee; and
(ii) advise the division in the division's investigation of these complaints.
(4) A board member who has, under Subsection (3), reviewed a complaint or advised in the
investigation of the complaint may be disqualified from participating with the board when the
board serves as a presiding officer in an adjudicative proceeding concerning the complaint.
