(1) Beginning January 1, 2028, a law enforcement agency shall ensure that every law enforcement officer who is on duty outside of the law enforcement agency's facility is supplied with a portable biometric capture device. (2) (a) A software vendor that allows a law enforcement agency to file a citation electronically as described in Section 77-7-20 shall ensure that the software vendor's software is capable of submitting biometric data captured by a portable biometric device electronically to the court's electronic filing interface. (b) A software vendor shall ensure that the connection described in Subsection (2)(a) is operational within one year of the criminal justice agency's system that uses the software service becoming active. (3) A software service is subject to Subsection (2) if the software service: (a) is for use by a criminal justice agency within the state's criminal justice system; and (b) collects and stores data required by statute to be reported to the department.
