As used in this part:
(1)
(a) "Biometric data" means data generated by automatic measurements of an individual's unique
biological characteristics.
(b) "Biometric data" includes data described in Subsection (1)(a) that is generated by automatic
measurements of an individual's fingerprint.
(c) "Biometric data" does not include:
(i) a physical or digital photograph;
(ii) a video or audio recording; or
(iii) data generated from an item described in Subsection (1)(c)(i) or (ii).
(2) "Portable biometric capture device" means a device or electronic application that:
(a) is able to accurately capture at least one form of an individual's biometric data;
(b) can be carried by a law enforcement officer, either on the law enforcement officer's person or
in the law enforcement officer's vehicle; and
(c) is capable of transmitting or allowing for the transfer of captured biometric data into a
law enforcement database so that the captured biometric data can be used to identify an
individual based on the individual's existing biometric data in the law enforcement database.
