(1) Except as provided in Subsection (3), on or before the last business day in August of an even- numbered year, the clerk of a special district shall send to each county clerk in which all or part of the special district is located a notice containing a list of names of all candidates who are qualified for placement on the regular general election ballot, by office, for each special district office. (2) Except as provided in Subsection (3), the clerk of a special district shall publish for the special district, as a class A notice under Section 63G-30-102, for 30 calendar days, the notice described in Subsection (1), beginning on the earlier of: (a) the first business day that is at least two calendar days after the day on which the clerk of the special district complies with Subsection (1); or (b) the second business day in September. (3) If the special district contracts for the county clerk to conduct the special district election: (a) the special district clerk is not required to comply with Subsection (1); and (b) the county clerk may publish the notice described in Subsection (2) for the special district clerk.
