Notice of election -- Publication required by election officer

(1) Except as otherwise provided for an election described in Section 20A-7-609.5, the election
officer for an election shall publish notice of the election, as described in Subsection (2), for the
jurisdiction as a class A notice under Section 63G-30-102, for at least 30 calendar days before
the day of the election.
(2) The election notice shall include:
(a) the heading "Election Notice," in bold;
(b) for an election notice given by a county clerk:
(i) if the election is a regular primary election, the following statement:
"Notice is given that a regular primary election will be held on Tuesday, [insert date] to
nominate party candidates for the parties and candidates for nonpartisan local school board
positions listed on the regular primary election ballot.";
(ii) if the election is a regular general election, the following statement:
"Notice is given that a regular general election will be held on Tuesday, [insert date] to elect
candidates to the offices listed on the regular general election ballot."; or
(iii) if the election is a special election or a presidential primary election, a statement, similar to
a statement described in Subsection (2)(b)(i) or (ii) that states the day, date, and purpose of
the election;
(c) for an election notice given by a municipal clerk:
(i) if the election is a municipal primary election, the following statement:
"Notice is given that a municipal primary election will be held on Tuesday, [insert date]
to nominate candidates for the municipal offices listed on the municipal primary election
ballot.";
(ii) if the election is a municipal general election, the following statement: "Notice is given that
a municipal general election will be held on Tuesday, [insert date] to elect candidates to the
offices listed on the municipal general election ballot."; or
(iii) if the election is a special election, a statement, similar to a statement described in
Subsection (2)(c)(i) or (ii) that states the day, date, and purpose of the election;
(d) for an election notice given by a special district clerk, a statement similar to the statements
described in Subsection (2)(b) or (c) that states the day, date, and purpose of the election;
(e) after the statement described in Subsection (2)(b), (c), or (d), as applicable, the following
statement:
"For voters receiving a ballot by mail, ballots will be mailed beginning 21 calendar days
before the election. The location of ballot drop boxes, the location and hours of polling places,
including early voting polling places and hours, and qualifications of individuals who may vote
in the election can be found at [insert name of election officer's or jurisdiction's website, if any,
and a state voting website designated by the lieutenant governor], by calling [insert phone
number for election officer's office], or at [insert street address of the election officer's office].

On the day of the election, the polls will open at 7 a.m. and continue open until 8 p.m. Attest:
[insert "County Clerk," "Municipal Clerk," or "Special District Clerk"]."; and
(f) after the statement described in Subsection (2)(e), instructions regarding how an individual
with a disability, who is not able to vote a manual ballot by mail, may obtain information on
voting in an accessible manner.
(3) The notice described in this section may not include the name of the election officer.
(4) The election officer shall include in the notice of election the notice of pre-election and post-
election automatic tabulating equipment testing described in Subsection 20A-4-104(1).
