Sec. 282.046. EMINENT DOMAIN. (a) On a resolution by the board, the district may exercise the power of eminent domain for the acquisition of property necessary to carry out the powers and duties of the district, including preventing damage to district property, property rights, equipment, hospital facilities and systems, and property adjacent to district property. (b) The district must exercise the power of eminent domain in the manner provided by Chapter 21 , Property Code, for the exercise of that power by a municipality. (c) The district may not exercise the power of eminent domain against: (1) a hospital, clinic, or sanatorium operated as a charitable, nonprofit establishment or operated by a religious organization; or (2) a privately owned or operated hospital or clinic, whether or not incorporated.
