Sec. 1251.116. LEGAL OR EQUITABLE ACTIONS; LIMITATIONS. A group accident and health insurance policy must provide that an action at law or in equity may not be brought to recover on the policy: (1) before the 61st day after the date written proof of loss is filed as required under the policy; or (2) after the third anniversary of the date on which written proof of loss is required under the policy to be filed.
