A. Sections 2 through 11 of this act shall be known and may be cited as the “Oklahoma Agriculture Pollutant Discharge Elimination System Act”. B. The purpose of the Oklahoma Agriculture Pollutant Discharge Elimination System Act is to: 1. Implement the federal National Pollutant Discharge Elimination System requirements; 2. Assist the Oklahoma Department of Agriculture, Food, and Forestry in obtaining authorization to implement the federal Clean Water Act programs; and 3. Issue permits to the persons or organizations owning or operating facilities regulated within the areas of environmental jurisdiction of the Department. C. The provisions contained in the Oklahoma Agriculture Pollutant Discharge Elimination System Act shall only apply to those programs established pursuant to the environmental jurisdiction of the Department as stated in Section 1-3-101 of Title 27A of the Oklahoma Statutes. D. Water programs within the environmental jurisdiction of the Department are hereby established that shall be responsible for: 1. Water quality including, but not limited to, point source and nonpoint source pollution; 2. Water protection; and 3. Discharges and potential discharges to waters of the state.
