Title 12A. Uniform Commercial Code: Obligation of good faith - Breach

Obligation of Good Faith.
Every contract of duty within the Uniform Commercial Code
imposes an obligation of good faith in its performance and
enforcement.  Breach of the obligation of good faith imposed by this
section shall not give rise to a separate tort cause of action.
Added by Laws 2005, c. 139, § 17, eff. Jan. 1, 2006.  Amended by
Laws 2013, 1st Ex.Sess., c. 16, § 2; Laws 2013, 1st Ex.Sess., c. 16,
§ 3.
NOTE:  Laws 2009, c. 228, § 21 was held unconstitutional by the
Oklahoma Supreme Court in the case of Douglas v. Cox Retirement
Properties, Inc., 2013 OK 37, 302 P.2d 789 (Okla. 2013) and repealed
by Laws 2013, 1st Ex.Sess., c. 16, § 1.
