North Dakota Code § 26.1-36-09.9

Dental anesthesia and hospitalization coverage
Open in Lexace · Ask the AI about this section
An insurance company, nonprofit health service corporation, or health maintenance
organization may not deliver, issue, execute, or renew any health insurance policy, health
service contract, or evidence of coverage on an individual, group, blanket, franchise, or
association basis unless the policy, contract, or evidence of coverage provides benefits for
anesthesia and hospitalization for dental care provided to a covered individual who is a child
under age nine, is severely disabled, or who has a medical condition and requires
hospitalization or general anesthesia for dental care treatment. A carrier may require
preauthorization of hospitalization for dental care procedures under this section in the same
manner preauthorization is required for hospitalization for other covered diseases or conditions.
Coverage under this section applies regardless of whether the services are provided in a
hospital or an ambulatory surgery center.
