* § 1640-j. Residential parking system in the village of Irvington. 1.\nNotwithstanding the provisions of any law to the contrary, the village\nboard of trustees of the village of Irvington may, by adoption of a\nlocal law or ordinance, provide for a residential parking permit system\nand fix and require the payment of fees applicable to parking within the\narea in which such parking system is in effect in accordance with the\nprovisions of this section.\n 2. Such residential parking permit system may only be established\nwithin the Main Street neighborhood of the village of Irvington, which\nshall mean that area generally bounded on the easterly side by North and\nSouth Dearman Street; on the northerly side by Matthiessen Park; on the\nwesterly side by North and South Astor Street and the Metro-North\nCommuter Railroad tracks; and on the southerly side by Station Road.\n 3. Notwithstanding the foregoing, no permit shall be required on\nstreets where the adjacent properties are zoned for commercial/retail\nuse.\n 4. The local law or ordinance providing for such residential parking\nsystem shall:\n (a) set forth factors necessitating the enactment of such parking\nsystem; and\n (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement; and\n (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect; and\n (d) make not less than twenty percent of all spaces within the permit\narea available to non-residents and shall provide for short-term parking\nof not less than ninety minutes in duration in such area; and\n (e) provide the schedule of fees to be paid for such permits; and\n (f) provide that such fees shall be credited to the general fund of\nthe village.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n * NB There are 2 § 1640-j's\n
