* § 1640-j. Residential parking system in the Garrett Park area of the\ncity of Yonkers. 1. Notwithstanding the provisions of any law to the\ncontrary, the city council of the city of Yonkers may, by adoption of a\nlocal law or ordinance, provide for a residential parking permit system\nand fix and require the payment of fees applicable to parking within the\narea in which such parking system is in effect in accordance with the\nprovisions of this section.\n  2. Such residential parking permit system may only be established\nwithin the Garrett Park area of the city of Yonkers which shall mean\nthat area encompassing Palmer Road, from Parkview Avenue to Bronxville\nRoad; Garrett Place; Parkview Avenue from Palmer Road to 103 Parkview\nAvenue, north of Pondfield Road West; Pondfield Road West from\nBronxville Road to the Bronxville border and Gard Avenue from Pondfield\nRoad West to 19 Gard Avenue, north of Pondfield Road West.\n  3. Notwithstanding the foregoing, no permit shall be required on\nstreets where the adjacent properties are zoned for commercial/retail\nuse.\n  4. The local law or ordinance providing for such residential parking\nsystem shall:\n  (a) set forth factors necessitating the enactment of such parking\nsystem; and\n  (b) provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement; and\n  (c) provide the times of the day and days of the week during which\npermit requirements shall be in effect; and\n  (d) make not less than twenty percent of all spaces within the permit\narea available to non-residents and shall provide for short-term parking\nof not less than ninety minutes in duration in such area; and\n  (e) provide the schedule of fees to be paid for such permits; and\n  (f) provide that such fees shall be credited to the general fund of\nthe city.\n  5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n  * NB There are 2 § 1640-j's\n
