§ 97-mmm. Archives records management account. 1. There is hereby\nestablished in the joint custody of the state comptroller and the\ncommissioner of the department of taxation and finance an account of the\nmiscellaneous internal service fund to be known as the archives records\nmanagement account.\n 2. Notwithstanding any other law, rule or regulation to the contrary,\nexpenditures from the archives records management account shall support\nrecords management activities pursuant to section 57.05 of the arts and\ncultural affairs law. This account shall consist of fees charged to\nstate, local and miscellaneous agencies, in accordance with section\n57.05 of the arts and cultural affairs law.\n 3. Notwithstanding any other law, rule or regulation to the contrary,\nthe comptroller is hereby authorized and directed to transfer to the\narchives records management account, within forty-five days of enactment\nof the state budget, fees for records management activities from various\nstate, local and miscellaneous agencies, and deposit in the archives\nrecords management account such amounts as determined by a schedule of\nfees developed by the commissioner of education and approved by the\ndirector of the budget, pursuant to section 57.05 of the arts and\ncultural affairs law.\n 4. Moneys of this account, following appropriation by the\nlegislature, shall be available to the state education department for\nservices and expenses of archives records management.\n
