§ 165.09 Auto stripping in the third degree.\n A person is guilty of auto stripping in the third degree when:\n 1. He or she removes or intentionally destroys or defaces any part of\na vehicle, other than an abandoned vehicle, as defined in subdivision\none of section one thousand two hundred twenty-four of the vehicle and\ntraffic law, without the permission of the owner; or\n 2. He or she removes or intentionally destroys or defaces any part of\nan abandoned vehicle, as defined in subdivision one of section one\nthousand two hundred twenty-four of the vehicle and traffic law, except\nthat it is a defense to such charge that such person was authorized to\ndo so pursuant to law or by permission of the owner.\n Auto stripping in the third degree is a class A misdemeanor.\n
