§ 71-1932. Definitions.\n  As used in section 71-1933 of this title, the following terms shall\nhave the following meanings:\n  1. "Hazardous substance" means any substance which:\n  a. is identified or listed as a hazardous waste or acute hazardous\nwaste in regulations promulgated pursuant to section 27-0903 of this\nchapter and all amendments thereto, regardless of whether at the time of\nrelease the substance was actually a waste; or\n  b. appears on the list of substances hazardous or acutely hazardous to\npublic health, safety or the environment promulgated pursuant to\nparagraphs (a) and (b) of subdivision one of section 37-0103 of this\nchapter and all amendments thereto.\n  2. "Organization" means a legal entity, other than a government,\nestablished or organized for any purpose, including, a corporation,\ncompany, association, firm, partnership, joint stock company,\nfoundation, institution, trust, society, union or any other association\nof persons.\n  3. "Person" means an individual, public or private corporation,\nresponsible corporate officer, political subdivision, government agency,\ndepartment or bureau of the state or federal government, municipality,\nindustry, co-partnership, association, firm, trust, estate or any other\nlegal entity whatsoever.\n  4. "Pollutant" means dredged spoil, solid waste, incinerator residue,\nsewage, garbage, sewage sludge, munitions, chemical wastes, biological\nmaterials, radioactive materials, heat, wrecked or discarded equipment,\nrock, sand and industrial, municipal and agricultural waste.\n  5. "Serious bodily injury" means "serious physical injury" as defined\nin subdivision ten of section ten of the penal law.\n  6. "Sewer system" means pipe lines or conduits, pumping stations, and\nforce mains, and all other constructions, devices, and appliances\nappurtenant thereto, used for conducting sewage, industrial waste or\nother wastes to a point of ultimate disposal.\n  7. "Treatment works" means any plant, disposal field, lagoon, pumping\nstation, constructed drainage ditch or surface water intercepting ditch,\nincinerator, area devoted to sanitary landfills, or other work not\nspecifically mentioned herein, installed for the purpose of treating,\nneutralizing, stabilizing, or disposing of sewage, industrial wastes or\nother wastes.\n
