§ 28-0111. Pollution prevention and environmental compliance\n coordinating council.\n 1. There is hereby established a pollution prevention and\nenvironmental compliance coordinating council which shall:\n a. provide guidance to the department on the development and\nimplementation of pollution prevention programs, including the small\nbusiness pollution prevention and environmental compliance assistance\nprogram and the identification of alternative compliance approaches that\nincorporate pollution prevention;\n b. coordinate the activities of the department, the environmental\nfacilities corporation, the department of economic development, the New\nYork state energy research and development authority and the New York\nfoundation for science, technology and innovation to promote pollution\nprevention and environmental compliance;\n c. make periodic reports to the governor and the legislature\nconcerning the effectiveness of pollution prevention programs, including\nthe adequacy of funding available, and difficulties encountered; and\n d. make recommendations for the development of programs to further\npromote pollution prevention and assist small businesses, including\ntechnical and financial assistance programs.\n 2. The pollution prevention and environmental compliance coordinating\ncouncil shall include the commissioner, the president of the\nenvironmental facilities corporation, the commissioner of economic\ndevelopment, the chairperson of the New York state energy research and\ndevelopment authority, and the executive director of the New York\nfoundation for science, technology and innovation; or their designees.\nThe council shall consult with representatives of businesses;\norganizations whose prime function is the enhancement of the\nenvironmental quality of the state; municipalities, not-for-profit\norganizations and private contractors which provide pollution prevention\nand compliance assistance; and any other parties the coordinating\ncouncil deems appropriate.\n 3. The coordinating council shall meet at least quarterly and shall\ndesignate one of its members to serve as chairperson and one of its\nmembers to serve as secretary for the development and dissemination of\nreports and advisory opinions. For the first year of its existence, the\ncoordinating council shall designate the commissioner or his or her\ndesignee to serve as chairperson.\n
