Commissioner required to report certain information or material; confidentiality of information or material provided; Commissioner authorized to enter into certain agreements and arrangements

1. Subject to any limitations or
restrictions contained in federal or state law governing the privacy or
confidentiality of records, the Commissioner shall report regularly any
violations of applicable laws committed by applicants for or holders of a
license or certificate, enforcement actions and other relevant information to
the Registry.
2. The requirements under any federal or
state law, including, without limitation, rules of a federal or state court,
regarding the privacy and confidentiality of any information or material
provided to the Registry and any privilege arising under federal or state law
with respect to such information or material, continue to apply to such
information or material after it has been disclosed to the Registry. Such
information and material may be shared with federal and state regulatory
officials with oversight authority over applicants for or holders of a license
or certificate without the loss of privilege or the loss of confidentiality
protections provided by federal or state law.
3. The Commissioner may enter into
agreements or sharing arrangements with other governmental agencies, the
Conference of State Bank Supervisors, the State Regulatory Registry, LLC, or
other associations representing governmental agencies.
