Petition for discontinuance; determination of need for referendum

1. At any time after 5 years after the
organization of a district under the provisions of this chapter, any 10
occupiers of land lying within the boundaries of such district may file a
petition with the Commission praying that the operations of the district be
terminated and the existence of the district be discontinued.
2. The Commission may conduct such public
meetings and public hearings upon such petition as may be necessary to assist
it in the consideration thereof.
3. The Commission shall determine, on the
basis of information presented in the petition or brought out in public
hearings and on the basis of the number of petitioners in relation to the total
number of occupiers of land lying within the district, whether it can render a
reasonable determination of approval or denial of the petition without holding
a referendum, or whether a referendum shall be held.
