Procedure for exclusion of land

1. Petitions to withdraw lands from a
district may be filed with the Commission at any time.
2. The Commission shall prescribe the form
of the petition, which shall be, as nearly as practicable, in the form
prescribed in this chapter for petitions to organize a district.
3. Where the total number of land
occupiers in the area affected by a proposed withdrawal will be less than 25,
the petition may be filed when signed by a majority of the occupiers of such
area, and in such case no referendum need be held.
4. In referenda upon petitions for
withdrawal, all occupiers of land lying within the area affected by the
proposed change in boundary shall be eligible to vote.
5. The Commission shall determine whether
or not such withdrawal shall be made.
