The State Engineer may approve an application for an environmental permit if: 1. The application is accompanied by the prescribed fees and a copy of a letter or order issued by the Division of Environmental Protection of the State Department of Conservation and Natural Resources requiring the applicant to take steps to protect the environment; 2. The appropriation is in the public interest; and 3. The appropriation does not impair water rights held by other persons.
