Unwarrantable failure of an operator to comply defined

Unwarrantable failure of an operator to
comply means the failure of an operator to prevent the occurrence of or to
abate a violation of a health or safety standard or regulation adopted pursuant
to the provisions of this chapter due to indifference, lack of diligence or
lack of reasonable care.
