Custody, use, preservation and confidentiality of information relating to applicants for and recipients of public assistance

1. To restrict the use or disclosure of
any information concerning applicants for or recipients of public assistance to
those purposes directly related to the administration of this chapter, and to
provide safeguards therefor, the board of county commissioners of each county
shall establish and enforce ordinances governing the custody, use and
preservation of the records, files and communications related to those persons
that are filed with the board.
2. If, under the provisions of law or the
ordinances of a board of county commissioners adopted pursuant to subsection 1,
the names and addresses of, or information concerning, applicants for or
recipients of public assistance are furnished to or held by any other agency or
department of government, the agency or department shall comply with the
ordinances of the board of county commissioners prohibiting the publication of
lists and records thereof or their use for purposes not directly connected with
the administration of this chapter.
3. Except for purposes directly related to
the administration of this chapter, no person may publish, disclose or use, or
permit or cause to be published, disclosed or used, any confidential
information relating to an applicant for or a recipient of public assistance
under the provisions of this chapter.
4. As used in this section, public
assistance means medical or financial assistance provided by a county pursuant
to this chapter.
