1. The State Department of Agriculture shall monitor public schools participating in the Program and ensure that participating schools comply with NRS 387.114 to 387.1175 , inclusive, and any regulations adopted pursuant thereto. 2. If the State Department of Agriculture determines at the end of a school year that a public school participating in the Program has not maintained or increased the provision of breakfast to enrolled pupils who are eligible for free or reduced-price lunches under the National School Lunch Act, the State Department of Agriculture shall provide written notice of its findings to the school. 3. A public school that receives notice pursuant to subsection 2 shall, not later than 30 days after receiving such notice, submit to the State Department of Agriculture a: (a) Statement identifying the reasons the school did not maintain or increase the provision of breakfast to pupils who are eligible for free or reduced-price lunches under the National School Lunch Act; and (b) Plan for increasing participation in the Program by enrolled pupils in the school who are eligible for free or reduced-price lunches under the National School Lunch Act that addresses the reasons identified in the statement submitted pursuant to paragraph (a).
