Nevada Code § 387.1155

Disbursements of money by State Department of Agriculture; waiver of requirements for participation in Program; adoption of regulations regarding waiver

1. For each school year, disbursements
from the State Department of Agriculture to public schools which are
participating in the Program must:
(a) Be paid in sequential order starting with the
public school with the highest percentage of enrolled pupils eligible for free
or reduced-price lunches under the National School Lunch Act.
(b) Be paid until all money available for the
Program for a school year is exhausted.
2. To the extent that money is available
and for each school year, the State Department of Agriculture shall allocate to
each public school that is participating in the Program an amount of money
necessary to carry out the Program, as determined by the Department in
accordance with subsection 1.
3. The State Department of Agriculture
shall adopt regulations prescribing the manner in which a public school that is
not otherwise required to participate in the Program may apply for and receive
a waiver of the requirements of NRS
387.1145 for the purpose of participating in the Program, including,
without limitation, any requirements to qualify for a waiver.
