1. The governing body may determine the qualifications of and appoint an Executive Officer for the Agency and may, within the limits of available funds, fix the salary of the Executive Officer. The governing body may also, within the limits of available funds, employ such other staff as may be necessary to execute the powers and functions provided for under NRS 278.780 to 278.828 , inclusive, or in accordance with any intergovernmental contracts or agreements which the Agency may be responsible for administering. 2. The Agency is a public employer for the purposes of chapter 286 of NRS, and a public agency for the purposes of chapter 287 of NRS. 3. The Attorney General may, upon request, act as the attorney for the Agency. If the Attorney General chooses not to represent the Agency, the Agency may employ legal counsel to act as its attorney.
