Nevada Code § 176.09165

Establishment of standard form concerning use and destruction of biological specimen and purging of DNA record; law enforcement to provide form to person in certain circumstances

1. The Department of Public Safety shall
establish a standard form for use by every law enforcement agency in this State
that:
(a) Sets forth the authorized use of a biological
specimen pursuant to NRS 176.0911 to 176.0919 , inclusive.
(b) Identifies the circumstances and process
under which a person may have his or her biological specimen destroyed and his
or her DNA profile or DNA record purged from the forensic laboratory, the State
DNA Database and CODIS.
(c) May be completed and submitted to the Central
Repository for Nevada Records of Criminal History by a person to request that
his or her biological specimen be destroyed and his or her DNA profile or DNA
record be purged from the forensic laboratory, the State DNA Database and
CODIS.
2. A law enforcement agency shall provide
the form to a person:
(a) Before obtaining a biological specimen;
(b) Upon release from custody if the person has
submitted a biological specimen; or
(c) At the request of the person, if the person
believes that he or she is eligible to have his or her biological specimen
destroyed and his or her DNA profile or DNA record purged from the forensic
laboratory, the State DNA Database and CODIS.
