(a) There is a Class B-theater license.
(b) The Board may issue the license for use in a theater that:
(1) is operated by a nonprofit organization;
(2) appears on the National Register of Historic Places;
(3) accommodates at least 1,400 individuals; and
(4) is located on the south side of Hagerstown.
(c) The license authorizes the license holder to sell beer, wine, and liquor
for on-premises consumption only to individuals who attend a performance or an
event held at the theater.
(d) The license holder may sell beer, wine, and liquor during the hours and
days as set out for a Class B beer, wine, and liquor license under § 31-2004 of this
title.
(e) (1) The annual license fee is $200.
(2) The fee for a Sunday permit is $250.
