Duty of peace officer

When any person with an intellectual disability departs without proper authority from a facilityin another state and is found in this state, any peace officerin any county in which such patient isfound may take and detain the patient without warrant or order and shall report suchdetention to the department. The departmentshall provide for thereturn ofthe patientto the authorities in the state from whichthe unauthorized departure was made. Pending return, such patient may be detained temporarily at one of the institutions of this state governed by the department. The provisions of this section relating to the department shall also apply to the return of other nonresident persons with an intellectual disability having legal residency outside the state of Iowa. 1120, §69, 130; 2023 Acts, ch 19, §426
