Sec. 12. (a) A two-thirds (2/3) vote of all the elected members, after unanimous consent of the members present to consider the ordinance, is required to pass an ordinance of a legislative body on the same day or at the same meeting at which it is introduced. (b) Subsection (a) does not apply to an ordinance that is: (1) initiated by a director, board, or commission and does not provide for an appropriation or tax levy or the incurring of any general obligation indebtedness; or (2) for a reappropriation or transfer of money previously appropriated by the annual budget ordinance. Such an ordinance may be passed by a majority vote on the same day or at the same meeting at which it is introduced. (c) Subsection (a) does not apply to a zoning ordinance or amendment to a zoning ordinance that is adopted under IC 36-7 . [Pre-Local Government Recodification Citation: 18-4-5-2(a).]
