Sec. 3. (a) Except as provided in subsection (b) or unless otherwise defined in statute, "accused", for purposes of IC 35-40 , has the meaning set forth in IC 35-40-4-2 . (b) "Accused", for purposes of IC 35-40-5-11.5 , has the meaning set forth in IC 35-40-5-11.5 .
