Sec. 95. "In good faith", for purposes of IC 34-13-3 and IC 34-30-15 , refers to an act taken: (1) without malice; (2) after a reasonable effort to obtain the facts of the matter; and (3) in the reasonable belief that the action taken is warranted by the facts known.
