Sec. 8. (a) The department may inspect the premises used by any timber buyer in the conduct of the timber buyer's business at any reasonable time and the books, accounts, records and papers of every such timber buyer shall at all times during business hours be subject to inspection by the department. (b) A timber buyer shall keep complete and accurate records and accounts for each transaction. The timber buyer shall retain records and accounts for not less than five (5) years after a transaction. (c) The information obtained under this section is exempt under IC 5-14-3-4 (a)(1). Unless otherwise required by judicial order, the information obtained under this section may be disclosed only as follows: (1) All of the information may be disclosed to the director or the director's designee. (2) If a timber buyer had transactions with a particular timber grower, information about those transactions may be disclosed to that timber grower. Formerly: Acts 1972, P.L.190, SEC.1.
