Sec. 48. (a) A crematory authority is not liable for civil damages for refusing to accept human remains or refusing to perform a cremation until the crematory authority receives a court order or other suitable confirmation that a dispute has been settled, if the authority: (1) is aware of a dispute concerning the cremation of the human remains; (2) has a reasonable basis for questioning any of the representations made by the authorizing agent; or (3) refuses to accept the human remains for any other lawful reason. (b) A crematory authority is not required to accept human remains for cremation.
