Sec. 4. (a) An owner or operator who violates section 1 of this chapter commits a Class B infraction.       (b) The department may assess a civil penalty of not more than ten thousand dollars ($10,000) against an owner or operator who violates section 1 of this chapter.       (c) An owner or operator who knowingly or intentionally violates section 1 of this chapter commits a Level 6 felony if the violation concerns the operation of a Class II well.       (d) A civil penalty assessed under this section shall be deposited in the oil and gas environmental fund established by IC 14-37-10-2 .   IC 14-37-12 Chapter 12.
