(a) Any rights created under this Act shall apply to any matter or
investigation not concluded as of the effective date of this Act.

 
(b) The provisions of this Act apply notwithstanding any contract or
agreement entered into before, on, or after the effective date of this
Act. Any contractual provision to the contrary is invalid and
unenforceable. No provision of this Act may be waived by any member
institution as a condition of continued membership in the association
or otherwise.
