(a) An institution, student, or employee who is subject to an investigation and penalties may waive any of the rights granted by this Act. (b) A waiver must be in writing, must be knowingly, freely, and voluntarily made, and must specify each right being waived. (c) A waiver may not be made irrevocable and may be revoked at any time by the institution, student, or employee giving the waiver. (d) A collegiate athletic association shall not, under any circumstances, require a waiver to be given or impose harsher penalties if the institution, student, or employee refuses or fails to give a waiver.
