(1) A notary public shall be liable for all damages proximately caused by his official misconduct. (2) The employer of a notary public shall be jointly and severally liable with such notary public for all damages proximately caused by the official misconduct of such notary public if: (a) The notary public was acting within the scope of his employment; and (b) The employer had actual knowledge of, or reasonably should have known of, the notary public's official misconduct.
