Where application for certificates of title made - procedure

(1) An
application for a certificate of title upon the sale, transfer, or movement into the state of any
manufactured home that does not become real property pursuant to section 38-29-114 (2) or
section 38-29-117 (6) shall be directed to the director and filed with the authorized agent of the
county or city or city and county in which such manufactured home is to be located. Upon sale
or transfer, an application for a certificate of title on a manufactured home shall be made within
forty-five days of the receipt of a manufacturer's certificate or statement of origin or its
equivalent. The authorized agents shall forward copies of all such applications to the county
assessor. Any person, other than an individual selling a manufactured home used as his
residence, who receives a commission or other valuable consideration for the transfer or sale of a
manufactured home shall fulfill the application and notice requirements of this subsection (1).
(2) Repealed.
