Streptococcus cash fund

(1) The executive director of the department of
public health and environment shall establish the fees to be collected for any streptococcus
culture test performed by the department.
(2) (a) All moneys collected pursuant to this part 12 shall be transmitted to the state
treasurer, who shall credit the same to the streptococcus cash fund, which fund is hereby created.
All moneys credited to the streptococcus cash fund shall be subject to appropriation by the
general assembly to be used as provided in this section and shall not be deposited in or
transferred to the general fund of this state or to any other fund.
(b) Repealed.
(3) (a) The executive director of the department of public health and environment shall
propose, as part of the annual budget request of the department of public health and
environment, an adjustment in the amount of the fee for the streptococcus culture test which the
department is authorized by law to collect. The budget request and the adjusted fees for the
streptococcus culture test shall reflect direct and indirect costs.
(b) Based upon the appropriation made by the general assembly, the executive director
of the department of public health and environment shall adjust the streptococcus fee so that the
revenue generated from said fee approximates the department's direct and indirect costs. Such
fee shall remain in effect for the fiscal year for which the budget request applies.
(c) Beginning July 1, 1984, and each July 1 thereafter, whenever moneys appropriated to
the department of public health and environment for its activities pursuant to this part 12 for the
prior fiscal year are unexpended, said moneys shall be made a part of the appropriation to the
department for the next fiscal year, and such amount shall not be raised from fees collected by
such department. If a supplemental appropriation is made to the department for such activities,
the streptococcus fee of the department, when adjusted for the fiscal year next following the year
in which the supplemental appropriation was made, shall be adjusted by an additional amount
which is sufficient to compensate for such supplemental appropriation. Moneys to be
appropriated annually to the department in the general appropriation bill for the purposes of this
part 12 shall be designated as cash funds and shall not exceed the amount anticipated to be raised
from such fee collected by the department.
