(1) The state board of education shall promulgate such rules and regulations as are necessary to implement this article, pursuant to section 24-4- 103, C.R.S. Such rules and regulations shall include, but shall not be limited to, the following: (a) Student eligibility criteria considering the special characteristics of the student, the educational record of the student to the time of application, and, if the student is enrolled in a public school program, the opportunities available to the student within that setting; (b) Criteria for eligible schools emphasizing experimental approaches such as a career development curriculum and experiential education; (c) Procedures for application by eligible schools and for selecting schools to participate in the second chance program; (d) Procedures for coordinating eligible participating students and eligible participating schools, including procedures to establish a lottery system when the number of applicants for an eligible school exceeds the available space; (e) Procedures for notifying the department of education and the student's school district of residence should the student stop attending or fail to make satisfactory progress; (f) Procedures for resolving disputes arising between school districts, schools, students, and parents consistent with article 4 of title 24, C.R.S.; and (g) Financial transactions.
